These Terms and Conditions govern your use of pingolg.com, your purchase of any Framer template sold through this site (including Noir Estates and Vesper), and any freelance web design services provided by Pingol G. ("I," "me," "my"). By booking a call, placing an order, or engaging my services, you agree to these terms.

This document is a commercial contract. Privacy and data-protection matters are covered separately in my Privacy Policy, which forms part of my agreement with every client and applies to all clients regardless of location, including international clients under GDPR where applicable.

1. Services Offered

I provide Framer-based web design services for service-based businesses, including:

●        Custom website design and development on Framer

●        CMS setup and content structuring

●        Automated booking system integration

●        CRM integration

●        Lead-capture form setup

●        SEO and AI-search (AIO) optimisation

●        Premium Framer templates sold as digital products (Basic and Pro tiers)

2. Quotes and Project Scope

All projects begin with an agreed scope, based on the plan selected (Basic, Growth, or Custom) or a written quote for custom work. Anything outside that agreed scope — additional pages, extra CMS collections, added integrations, or new revision rounds beyond what's included — is treated as a change request and billed separately, at a rate agreed before the additional work begins. This protects both of us from scope creep on either side.

3. Payment Terms

Projects require an upfront deposit before work begins. For most projects this is 50% of the total project cost; for larger Custom projects this may be split across milestones, agreed in writing beforehand. The remaining balance is due upon project completion, before final files or access are handed over.

Accepted payment methods: Stripe, PayPal, Polar.sh, bank transfer/UPI for Indian clients, and Wise for international clients.

Late payments on the final balance may incur a service charge of 1.5% per month until paid.

Template purchases (Noir Estates, Vesper, etc.) are paid in full at checkout.

International payments

For clients paying from outside India, currency conversion, international transfer fees, and any applicable withholding tax are the client's responsibility unless otherwise agreed in writing. Prices quoted are exclusive of the client's local taxes unless stated otherwise.

4. Refund Policy

Refunds follow standard industry practice for custom web design work:

●        Before work begins: if you cancel before I've started any work on your project, you'll receive a full refund of your deposit, less any payment processing fees already incurred.

●        After work begins: the deposit becomes non-refundable once work has started, as it reserves my time and turns down other client work. This is standard practice across the web design industry.

●        Milestone-based projects: for larger Custom projects billed in milestones, payments already made for completed milestones are non-refundable; only the unpaid, not-yet-started portion of the project can be cancelled without charge.

●        Completed projects: once a project is delivered and final payment is made, no refunds are issued — you may of course request revisions within the scope already agreed.

●        Templates: as digital, downloadable products, template purchases (Noir Estates, Vesper, etc.) are non-refundable once the files have been delivered or downloaded, except where the product is materially faulty.

If something isn't working as agreed, my first step is always to fix it — not to issue a refund. Reach out and I'll make it right.

5. Revisions

Each plan includes a defined number of revision rounds (see your project proposal). Revisions must relate to the original agreed scope. Requests for new features, new pages, or design directions not covered in the original brief are treated as change requests under Section 2.

6. Turnaround Time

Turnaround times quoted (e.g. 48-hour design delivery, 1–3 week project timelines) are estimates based on timely delivery of your content, feedback, and approvals. Delays on your end in providing brand assets, copy, or feedback will proportionally extend the delivery timeline. For international clients, project timelines are estimated in Indian Standard Time (IST) unless otherwise agreed.

7. Intellectual Property and Project Ownership

Upon full and final payment, ownership of the completed website is transferred to you. I do not retain a copy of your live project inside my own Framer workspace after handoff — the finished site is transferred directly to your Framer account/device.

I retain the right to use screenshots, links, and descriptions of completed projects in my portfolio, case studies, and marketing materials, unless you request confidentiality in writing before the project begins (see Section 9).

Until final payment is received, all work-in-progress design and code remains my property. Any Framer templates, design systems, or reusable components I've built independently of your project (i.e. not custom-built for you specifically) remain my property, even if used within your site.

Purchased templates (Noir Estates, Vesper) are licensed for use on a single live website per purchase. They may not be resold, redistributed, or repackaged as a competing template product.

8. Client-Supplied Content and Data

Where you provide personal data belonging to your own customers or employees (for example, via CRM integration or a lead-capture form I build for you), you remain the data controller/fiduciary for that data, and I act only as a processor carrying out your instructions. You are responsible for ensuring you have a lawful basis to share that data with me and for meeting your own obligations under DPDP, GDPR, or other applicable law. If your organisation requires a separate Data Processing Agreement covering this arrangement, let me know before the project begins.

9. Confidentiality

I treat all client information, brand assets, and business details shared during a project as confidential, and won't disclose them to third parties without your permission, except as described in my Privacy Policy. If you require a signed NDA before sharing sensitive information, let me know before the project starts.

10. Liability

My services and deliverables are provided as-is. I am not liable for indirect, incidental, or consequential damages — including lost profits or lost business — arising from the use of the completed website. My total liability for any claim relating to a project is limited to the total amount you paid me for that project.

I am not responsible for third-party services integrated into your site (payment processors, CRMs, booking tools, hosting providers) once the project is handed off — issues with those tools should be directed to the relevant provider.

11. Termination

Either party may terminate an ongoing project with written notice. If you terminate:

●        Any deposit or milestone payments already made are non-refundable per Section 4.

●        You'll receive whatever work has been completed up to that point.

●        Any outstanding balance for completed work is still due.

If I terminate a project (rare, but reserved for cases like non-payment or unworkable client conduct), you'll be refunded for any milestone not yet started.

12. Force Majeure

Neither party is liable for delays caused by circumstances beyond reasonable control (natural disasters, internet/service outages, illness, etc.).

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising from these Terms or a project engagement will first be handled through good-faith direct discussion. If unresolved, disputes fall under the exclusive jurisdiction of the courts of West Bengal, India. This applies to international clients as well; engaging my services means accepting Indian law and West Bengal jurisdiction as the governing framework for any contractual dispute, separate from any data-protection rights you hold under your own local law (see Privacy Policy, Section 12).

14. Changes to These Terms

I may update these Terms as my services evolve. The version in effect at the time you book or purchase is the one that applies to your engagement.
